Certain Nonimmigrant visas exist to allow Fiancés of American citizens and Spouses (and children of spouses) of U.S. Citizens to enter the United States to complete the immigration process. Other family visas exist including N Visas, a nonimmigrant classification to minimize any family separations caused by ineligibility for special immigrant status of certain parents and children. Please click on the Family Visa drop down menu to get more information on K Visa and N Visa.

It is impossible to predict the movement of priority dates. Your guess is as good as mine.

My mom is a widow. My step-dad took care of her for 30 years. She never became a citizen. Can she qualify for his social security benefits?

Switching status from A2
My mother entered USA with an A2 Visa to accompany my wife, a principal holder of an A2 Visa . My mother’s visa expired but she needs to extend her staying with us in the States. The office of foreign mission rejected the renewal. Also note that my Mom has a sister who is a USA Citizen. What can she do to legally extend staying with us at least till my wife’s posting ends in 1.5 years ?

Switching status from A2
A visas have some very specific rules. I do not recall them off-hand. Try searching for A-2 visa and unlawful presence.

Marriage based immigration
My wife is on F1 STEM OPT with 2 years left. I have a Green Card. If we file I 130 and I 485 together? Can she stay in the usa legally and work? I know processing time for I 130 and I 485 can be long. So can I also apply fro I 765 to get EAD card before her STEM OPT expires?

Marriage based immigration; green card holder spouse
If the priority dates are current, you can file I-130 and I-1485 together. Then, she can stay. You can also apply for her EAD. But the dates are slipping back, beginning April 1. Unless they become current again, you cannot file I-485. You may want to discuss your options with a lawyer.
