USCIS Enhances TNC Process

    We have rolled out a new set of E-Verify enhancements improving the Tentative Nonconfirmation (TNC) communication process. The highlight of the latest enhancements is the combining of the TNC Notice and Referral Letter into one document – the Further Action Notice.

    The Further Action Notice simplifies the TNC communication process by combining the employee’s biographical information, the reason for the TNC, the employee’s decision to contest, and employee instructions for contesting a TNC into a single document.

    Employers will notice fewer screens to click through resulting in a clearer process and decreased case processing time. For more information on the TNC process, visit the Tentative Nonconfirmations page.

    What you need to know:

    • Starting on September 8, 2013, the TNC Notice and Referral Letter will be replaced by the Further Action Notice. For samples, visit the Publications page.
    • When TNC cases are referred to SSA or DHS, employers must provide employees with the Referral Date Confirmation. For samples, visit the Publications page.
    • A new email notification will be sent to employees when their cases are referred to SSA or DHS. For more information, visit the Employee Tentative Nonconfirmation Email Notification page.
    • TNC cases existing during the transition will remain valid. Additional information on how to handle existing TNC cases is provided below:
    If... Then...
    The case is at the SSA or DHS TNC verification result screen before September 8, 2013. When you click ‘Continue,’ the updated screen will display and the new Further Action Notice will be available. Follow the instructions on the screen to continue the TNC process.
    The employee was notified of the TNC and was provided with a TNC Notice before September 8, 2013 but was not referred to SSA or DHS. You will still need to confirm the employee’s decision in E-Verify. Follow the instructions on the screen to continue the TNC process.
    The employee was not notified of the TNC before September 8, 2013. Print the new Further Action Notice and follow the instructions on the screen to continue the TNC process.
    The case was referred to SSA or DHS before September 8, 2013 but the employee was not provided with a Referral Letter. Print the Further Action Notice and the Referral Date Confirmation and provide both to the employee.
    The case was referred to SSA or DHS before September 8, 2013 and the employee was provided a Referral Letter. No additional action is required. The old Referral Letter and the new Further Action Notice contain the same information on how to contest the SSA or DHS TNC.
