Hi Rajiv I am a first year computer science student in Mumbai University I plan on moving to the States after graduation so I looked at my options I could continue my studies in an American University on F-1 Visa or if I could land a job If I could get an H1-B visa I was wondering whether I can apply under EB1a green card because it doesn't require an employer or could I apply under an 0-1 visa So I went through the eb1a criteria and it confused me a lot So I actually won an competitive programming contest for software developers called techgig code gladiators which is the biggest programming contest in india certified by Limca Book of World records does that qualify me for the first criteria of extraordinary ability of a one time achievement . I have had another doubt whether it is possible to apply for eb1a visa as a student . My income is generated by participating in various hackathons and winning their prizes some as big as 20000$ . So my finances are decent . If I am not eligible to apply for eb 1a or O-1 in this current situation then please tell how should I build my resume to meet the requirements of eb1a green card . Do I need a job in an MNC like Google or Amazon at a high post Or do I need to get a PhD to apply. Or do I need to publish articles and editorials about software development . MOST IMP : Please give me advice on how should I build my resume in order to qualify for an EB1a green card as a 'STUDENT' who does not have a job currently. Thanks for your generosity , Rajiv

These visa categories are reserved for people who will be considered to be top 10% of their profession. Typically if you win a one-time national or international award that is considered to be prestigious, you may be able to qualify. Minor awards may not meet these requirements.

People who have not won such an award must demonstrate sustained national or international acclaim through the methodology that has been described on our website as well as in our frequently asked questions in several videos.

Hello Sir,

I work at a very prestigious MNC ( within fortune too 10) and I am a senior Product manager with that organization. I am moved from India on an L1A last month. As it’s a product manager role I donot have direct reportees but I do take care of my product and software engineers functionally. My organization is not in favor of eb1c as it’s a tough battle and would lead to additional rfe. Can I file independently and if yes what’s the probability of getting it.

Hi, Im currently on an L1A visa and a Senior Product Manager here in the US. I had 2 direct reportees back in India when I transferred here and have 2 US based reportees in my role here. Additionally, I qualify as a functional manager since I influence multiple teams in terms of their work and KRA definitions. I wanted to know if my profile sounds like the kind that would generally qualify for the EB1C if I applied for it and then depending on the answer I can have a word with my employer !

Thank You

Hi, I am currently on L1A and my family (Spouse and 2 Sons) are on L2 status. We moved in US last month, my eldest son will turn into 21 on next August 2023. I want to apply for EB1C (Green card). My company will sponsor my change of status. How urgent should I apply for EB1C to get my eldest son added in application.

Hello Rajiv,

I am working as a lead user experience engineer at a leading insurance company in America, wherein I lead the effort to make their offerings more inclusive for individuals with disabilities (basically making the apps ADA and section 508 compliant). I design and implement programs aimed at making our products accessible by empowering product teams to plan, construct, examine, and introduce accessible features.

I collaborate closely with design/research, engineering product leads, quality assurance, operations, and various cross-functional partners to build support for the accessibility program and provide expertise and guidance to different teams.

I also work in close partnership with the design system and framework teams, as well as engineering teams, to enhance accessibility support at the system level and drive investments in engineering to create and scale accessible products. My qualifications include being an IAAP Certified Professional in Web Accessibility (CPWA), which puts me in the elite group of 1500 people worldwide.

Your expert opinion is much appreciated.

Thanks Param
