H1B count Update
A total of approximately 53,800 H-1B cap-subject petitions had been filed as of October 30, 2009. Since the sufficient H1-B petitions for aliens with advanced degrees has met the 20,000 limit, any H1-B petitions filed on behalf of such aliens will now count towards the general H1-B cap of 65,000. USCIS will continue to accept both cap-subject petitions and advanced degree petitions until statutory limits are met.
Return of TARP Funds
USCIS is waiting for information and guidance from DOL with respect to TARP funds.
I-360/I-485 Package acceptance on Reauthorization of the Religious Worker Program
USCIS confirmed the acceptance of concurrently filed I-360/I-485 filings after the passage and signature of the FY10 Department of Homeland Security Appropriations bill (P.L.111-83) on October 28, 2009, reauthorizing the religious worker program. The cut-off dates for Employment Fourth Preference Certain Religious Workers would become “current” if there was legislative action.
