I had an accident and am on disability while my green card adjustment of status application ( form I-485 ) has been pending for over 4 years. My I-140 had been approved about 5 years back but my case has been caught up in the visa backlogs at USCIS and Department of State. I wanted to know if there was any provision for help in the immigration laws, in case I am sent for long term disability or my employment is terminated before I receive my green card. I learnt that employment and disability are subjects to be discussed with a benefits or employment attorney. The only immigration benefits are via AC 21 or via a private bill. Also, that one should not loose the advance parole anytime while the AOS is pending. I want to thank Mr. Rajiv Khanna for his generosity with time and expert guidance. Over the phone I found him to have a very pleasant personality. he had me feel comfortable and didnt seem money minded at all.

Green Card for RN

Question details

I am an RN with a TN visa from Canada. My wife who is an American Indian born in Canada will soon be sponsoring me. Will the fact that I have a visa speed up the process?

It will not speed things up, but filing for Adjustment of Status (which is available only to folks who are already in USA), makes it possible to continue to stay in USA while the green card process is in the works.

Work Done : Employment Based Green Card Can people contact me as a reference: Yes I got my Green card approved on July1st 2010. I started the Whole process on April 2005 with Rajiv Khanna as my attorney. I must mention the speed at which they got my labor and 140 approved was very impressive.I must also mention the paper work done under his team's guidance was very methodical and I belive it helped me get my GC approved without any RFE's. I was very impressed with mr khanna's staff in general and with a special mention of mr mathew and bharathi who were very patient will all my questions and concerns.I was also very impressed with the way my daughter's case was handled by Mr Khanna and his staff, recommending me with different options and advicing me to do the right thing at the right time. My daughter's case was very unique and Mr Khanna and his staff had very clear understanding on her case and adviced me to do the right thing and finally on Feb20th 2011 her case was resolved. Without Mr Khanna and his staff I do not think my daughter would have got her green card. I highly recommend Mr Khanna's office to anyone who wants to apply for green card or any other immigration related issues.

I am on EB3 category and have been working in the IT sector for the last 6 years and one year ago I completed my MBA too. I am currently working as a contractor and using my EAD. I am on Adjustment of status right now. Is it possible to change my category from EB3 to EB2?

It is possible, but the green card will have to be started again from PERM.

I got my BSN in the US

I got my BSN in the US, passed NCLEX and got my employment authorization. I am currently on F1 visa, and working at a nursing home. I live in MN and it was extremely hard to get a job. How do I apply for a green card and what role will my employer play in this process? Is it going to cost my employer any money? And how long is it going to take to get a green card?

Your employer's role in this process is limited. You can pay for all expenses yourself. The length of the process is determined by the country of birth.
